These Terms & Conditions ("Terms") govern your use of basketballcareer.app and the Basketball Career game (together, the "Service"). The Service is operated by AdTech Consulting Group LLC, a Wyoming limited liability company with a registered address at 30 N Gould St Ste R, Sheridan, WY 82801, United States ("we", "us", "our"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

Basketball Career is a free, single-player basketball career simulation game that runs in your web browser. It is entertainment only. Results come from game rules and random chance. They don't predict, reflect or rate any real person, team or event.

2. Eligibility

The Service is for a general audience. If you are under the age of majority where you live, use the Service only with the permission of a parent or legal guardian, who agrees to these Terms for you. The Service is not directed to children under 13.

3. No accounts, purchases or prizes

The Service needs no account and has no purchases, virtual currency, subscriptions, wagering or real-world prizes. Scores, ratings, trophies and Hall of Fame results exist only inside the game and have no monetary value.

4. Fictional content and no affiliation

All teams, schools, leagues, competitions, awards, players and other people in the Service are fictional. Any resemblance to real people, teams or organizations is coincidental. The Service is not affiliated with, endorsed by or sponsored by any professional or amateur basketball league, team, federation, college athletics association or players' association. Any third-party names or marks belong to their owners.

5. Your license to use the Service

We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. You may share the career summaries and share-card images the game makes for you, for example on social media, for personal, non-commercial purposes.

6. Acceptable use

You agree not to:

• copy, resell, rehost, frame or distribute the Service or its code, art or text, except as these Terms allow;
• use bots, scrapers or automated means to access the Service in a way that burdens or disrupts it;
• try to break, probe or bypass the Service's security, or interfere with other people's use of it;
• use the Service for anything unlawful, harmful, harassing or deceptive.

7. Custom name packs

The game lets you load your own name pack, a file that renames the game's teams, on your device. A name pack stays in your browser and is never uploaded to us. You are solely responsible for what you load and for making sure you have the right to use it. Don't use name packs to infringe anyone's rights or to create misleading or offensive content.

7a. Daily Draft leaderboard

When you finish a Daily Draft, your player's last name, position and score are posted to a public leaderboard. Don't use names that are offensive, impersonate someone or include personal information. Don't try to submit scores you didn't earn in the game. We may remove any entry or reset the leaderboard at any time. The leaderboard is for fun: it carries no prizes.

8. Intellectual property

The Service, including its software, design, graphics, text, game systems and the Basketball Career name and logo, is owned by us or our licensors and is protected by intellectual property laws. Except for the license in section 5, no rights are granted to you. If you believe something in the Service infringes your rights, email support@vimay.group with the details and we'll review it promptly.

9. Feedback

If you send us ideas or suggestions, we may use them freely and without any obligation to you.

10. Saved progress and availability

Your career and settings are saved only in your browser's local storage. Clearing your browser data, using private browsing or switching devices can delete or hide your progress, and we can't recover it. We may change, pause or stop any part of the Service at any time, and we don't guarantee that it will always be available or error-free.

11. Third-party services

The Service uses third-party services, such as web fonts and, if you allow it, analytics, as described in our Privacy Policy. Their own terms govern your use of them, and we aren't responsible for them.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR MEMBERS, MANAGERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED FIFTY US DOLLARS (US$50). Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

14. Indemnity

You agree to defend, indemnify and hold us harmless from any claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Service or your breach of these Terms.

15. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought only in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction. Before filing a claim, please email support@vimay.group so we can try to resolve it informally.

16. Termination

We may suspend or end your access to the Service at any time if you breach these Terms. Sections 4 and 8 through 17 survive termination.

17. Changes and general terms

We may update these Terms from time to time. We'll change the "Last updated" date above, and continuing to use the Service means you accept the updated Terms. If any provision is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. These Terms are the entire agreement between you and us about the Service, and you may not assign them without our consent.
